The Nonsense Pit Terms and Conditions


1 Who we are

1.1 We are Time Products UK Limited, trading as Sekonda, with our registered office address at 27 Berkeley Square, London, England, W1J 6EL (referred to below as "Sekonda", "we", "us", "our").

2 The competition

2.1 These terms and conditions (referred to below as "Terms and Conditions") apply to the 'WIN A £100 SEKONDA E-GIFT CARD NONSENSE PIT' Competition (referred to below as the "Competition") in which one £100 Sekonda e-gift card can be won (the "Prize").

2.2 By entering into the Competition entrants (also referred to below as "you" or "your") agree to be bound by these Terms and Conditions.

2.3 We reserve the right to refuse entry, or refuse to award the Prize to anyone in breach of these Terms and Conditions.

3 How to enter

3.1 The Competition opens at 14:00pm on Thursday 02/02/21 (the "Opening Date") and closes at 12:00pm on Wednesday 22/12/21 (the "Closing Date") inclusive which is the "Competition Period".

3.2 Entries submitted before the Opening Date or after the Closing Date shall not be accepted and will be automatically disqualified.

3.3 To enter the Competition:
3.3.1 you must submit an entry to the Nonsense Pit at (the "Nonsense Pit Website") telling us about a nonsense you're tired of (your "Nonsense Entry"); and 3.3.2 once you have submitted your Nonsense Entry to the Nonsense Pit Website, you will either need to:
(a) provide your name and email address. Once you have provided your name and email address, you will then need to verify your email address by clicking the link in the email that we will send to you to confirm your email address. You will not be able to enter the Competition without verifying your email address; or
(b) enter via your Facebook account in which case we will receive your name, email address and an ID number from Facebook.
3.4 The Competition is free to enter. No purchase of any kind is necessary to take part in this Competition.
3.5 Sekonda will not accept:
3.5.1 responsibility for Nonsense Entries that are lost, mislaid, damaged or delayed in transit or corrupted, regardless of cause, including, for example, as a result of any equipment failure, technical malfunction, systems, satellite, network, server, computer hardware or software failure of any kind; or
3.5.2 proof of transmission as proof of receipt of entry to the Competition.

4 Eligibility

4.1 The Competition is open to all residents of mainland United Kingdom except:
4.1.1 employees of Sekonda or its holding or subsidiary companies; and
4.1.2 anyone professionally involved in the Competition.

4.2 If you are 16 years of age or younger, you must have the prior permission of your parent or guardian to enter.

4.3 In entering the Competition, you confirm that you are eligible to do so and eligible to claim the Prize. We may require you to provide proof that you are eligible to enter the Competition.

4.4 We will not accept Nonsense Entries that are
4.4.1 automatically generated by computer; or
4.4.2 completed by third parties or in bulk.

4.5 Nonsense Entries which are discriminatory, offensive, defamatory, contain expletives, refer to specific individuals or brands or are otherwise inappropriate, to be determined in our sole discretion, will not be valid and will be disqualified from the Competition.

4.6 We will monitor Nonsense Entries submitted to the Nonsense Pit Website daily and Nonsense Entries which fall foul of the requirements set out in these Terms and Conditions will be removed from the Nonsense Pit Website and disqualified from the Competition.

4.7 Multiple entries are permitted but there is only one Prize to be won.

4.8 Sekonda reserves all rights to disqualify you if your conduct including your Nonsense Entry is contrary to the spirit or intention of the Competition.

5 Voting

5.1 All valid Nonsense Entries will be displayed on the Nonsense Pit Website and may be otherwise shared by Sekonda as set out in further detail in paragraph 9.

5.2 A person can vote for the Nonsense Entries that they consider to be the best (or worst!).

5.3 Individuals will be able to cast a vote by giving a ‘thumbs up' to a Nonsense Entry on the Nonsense Pit Website. Individuals can give a ‘thumbs up' to an unlimited number of Nonsense Entries, although they will only be able to vote for each Nonsense Entry once.

5.4 An individual may be able to change their vote(s) if they access the Nonsense Pit Website from the same device and location.

5.5 Votes cast after the Closing Date will not be counted.

5.6 Entrants agree that proof of submitting their Nonsense Entry to the Nonsense Pit Website shall not be proof of Sekonda's receipt of any Nonsense Entry.

6 The Prize

6.1 The Prize for the winning Nonsense Entry is a Sekonda e-gift card which is limited to the value of £100.00.

6.2 No cash alternatives are available.

6.3 The Prize is non-transferable and may not be sold, offered for sale, coupled or bundled with any other product or services or used for any commercial or promotional purposes whatsoever.

7 Announcing the winner

7.1 There will be one (1) winner

7.2 Once the Competition Period has closed, the winner will be determined by the Nonsense Pit Entry with the highest number of votes from all valid and eligible Nonsense Pit Entries submitted during the Competition Period. In the event of a tie, the Nonsense Entry that reached the relevant number of votes first in time will be the winner.

7.3 The decision of Sekonda is final and no correspondence will be entered into.

7.4 Sekonda will notify the winner personally as soon as practical after the Closing Date, and in any event by 4pm on Wednesday 22.12.21 using the email address provided at entry.

7.5 If the Winner cannot be contacted and does not respond by midday on 24/12/21 Sekonda reserves the right to select the next highest voted Nonsense Entry as the winner.

7.6 The Sekonda E-Gift card will be sent to the winner's provided email address for them to spend on

7.7 Sekonda must either publish or make available information that indicates that a valid award took place. To comply with this obligation Sekonda will send the surname and county of the prize winner and, if applicable copies of their winning entry, to anyone who emails [email protected] or writes to the address set out in paragraph 1.1 (enclosing a self-addressed envelope) within one month after the Closing Date of the Competition.

7.8 If you object to any or all of your surname, county and winning entry being made available, please contact us via [email protected] or . In such circumstances, we must still provide the information and winning entry to the Advertising Standards Authority on request.

8 Discount code

8.1 Entrants to the Competition will automatically receive a 10% discount code to use on

8.2 The discount code will expire at 23.59 on Wednesday 22.12.2021.

8.3 The discount code cannot be used in conjunction with other discounts codes, vouchers and/or offers. Discount is not valid on e-gift cards or premium gift boxes.

9 Data protection and publicity

9.1 We will process your personal information in accordance with our privacy policy.

9.2 The winner may be asked to take part in publicity related to the Competition. Such publicity may include use of the entrant's winning Nonsense Entry and social media handle.

10 Limitation of liability

10.1 Insofar as is permitted by law, Sekonda, its agents or distributors will not in any circumstances be responsible or liable to compensate the winner or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the negligence of Sekonda, its agents or distributors or that of their employees. Your statutory rights are not affected.

10.2 Entrants accept that the Nonsense Pit Website is offered on an "as is" and "as available" basis. While Sekonda takes all reasonable steps to ensure that the Nonsense Pit Website is properly functioning at all times, Sekonda does not warrant that the Nonsense Pit Website will be uninterrupted, timely, secure or error-free, that defects will be corrected, or that the Nonsense Pit Website or the server that makes it available are free of software viruses or bugs or other defects.

11 Ownership of competition entries and intellectual property rights

11.1 All Nonsense Entries and any accompanying material submitted to Sekonda will become the property of Sekonda on receipt and will not be returned.
11.2 By submitting your Nonsense Entry and any accompanying material, you agree to:
11.2.1 assign to Sekonda all your intellectual property rights with full title guarantee; and
11.2.2 waive all moral rights, in and to your Nonsense Entry and otherwise arising in connection with your Nonsense Entry to which you may now or at any time in the future be entitled under the Copyright, Designs and Patents Act 1988 as amended from time to time and under all similar legislation from time to time in force anywhere in the world.

11.3 You agree that Sekonda may, but is not required to, make your Nonsense Entry available on the Nonsense Pit Website and any other media, whether now known or invented in the future, and in connection with any publicity of the Competition. You agree to grant Sekonda a non-exclusive, worldwide, irrevocable licence, for the full period of any intellectual property rights in the competition entry, to use, display, publish, transmit, copy, edit, alter, store, re- format and sub-licence the Competition entry for such purposes.

12 General

12.1 Sekonda reserves the right to hold void, suspend, cancel, or amend the Competition or these Terms and Conditions where it becomes necessary to do so.

12.2 All entry instructions form part of these Terms and Conditions. English law governs this Competition and each party submits to the exclusive jurisdiction of the English courts.
